No, they would need to pass a veto proof joint resolution to override the declaration.

That won't happen so the constitutionality of the declaration will need to be contested.

The question I have is, while the case works its way up to the Supreme Court, will the declaration be permitted to take effect?

This declaration is just a trial for bigger democracy-killing declarations coming later.

I believe you are correct.

@joBo - The NY calculation was forecasting an ROI or 9:1 on public dollars spent. Those secondary jobs and support services that would crop up with 25K new needy people injected into god paying jobs in LIC. Its hardly like LIC is a opportunity zone, it was just a chance to move the slacker/hipster class farther out.

Apparently VA forecasted that the Amazon footprint in Crystal City would max out around ~38,000 direct hire jobs, so they feel good at maximizing the investment. I still think that some portion of these jobs end up out in the silicon alley (if so I have a recently substantially remodeled single family home available for $1.7M, maybe $1.6 for an internet friend).

I understand where you're coming from but I have to disagree.

I fear that, from a legal standpoint, he and the other justices will view this as less of a Constitutional issue and more of a Congressional screwup. Although the Constitution gives Congress the power of the purse there is the argument that Congress ceded some of that power to the President in the National Emergencies Act. Congress gave themselves certain checks and balances in that Congress can undo a state of emergency declaration with either a joint resolution and the President's signature, or with a veto-proof majority vote. However, in this case it's likely that neither of those will occur. In such a case I think it's possible -- perhaps likely -- that SCOTUS will defer to Congress' wishes (and the President's discretion) as set forth in the NEA and as confirmed by their not overriding the President's declaration. Essentially they'll be saying to Congress: "You created this situation by ceding some of your power to the President in the National Emergencies Act. If you now don't like the outcome, change the law."

Bill Weld forming an exploratory committee to challenge Dictator Trump in 2020.

"I hope to see the Republican Party assume once again the mantle of being the party of Lincoln. It upsets me that our energies as a society are being sapped by the President's culture of divisiveness in Washington," he said Friday in New Hampshire. "Because of the many concerns, I've established an exploratory committee ... as a Republican in the 2020 election."

This is also my take. This was made into a judgement call and I think the fix is in. Roberts won't do anything because he has a reasonable out, that being the NEA. I don't think it's SCOTUS' call to say what is an emergency or not. It's up to the president and the discretion given to him by a nearly dead branch of our government.

I would also add that Trump is going to jail as soon as he's not president anymore. He has an enormous incentive to try to disrupt our democracy and stay president as long as possible. If he pulls this off, I honestly think he'll manufacture another emergency and try to suspend elections until after the emergency. That's how authoritarians seize power and that's what he is. Add in the incentive to avoid jail and maybe keep his family out of prison, and I really think he'll do it. I know that sounds crazy, but he's been willing to cross pretty much every line out there.

I'm not watching but apparently Trump's speech announcing the "national emergency" is an all-timer.

Yeah, I really do feel that SCOTUS will save us this time.

Trump is a fascist, I don't think that is true of the right wingers on the bench. Hopefully they prioritize the good of the country when they make their decision, and hopefully they don't take the case until Trump is out of office.

Who knows? Maybe they will refuse to take the case and allow the 9th Circuit Court's decision to stay in force.

Kinda want SCOTUS to completely defer to the president on this so the next dem president can do literally everything by executive action!

Definitely feels like this is a new idea in political discourse. I have heard the facts and history on what he is talking about. Feels like a good time to mention a Radio Lab three part series that discusses it. Regardless, new idea that could definitely have him stand out on this issue in the primaries.
