A good place to start is the book The Broken Branch by Mann and Ornstein. But basically, since the 60s, Congress simply has not been able to develop policy--to get anything done has required the executive branch to take the lead.

I think if the dems take the senate and the White House in 2020 they need to eliminate the filibuster and go for Medicare for all. Then Biden an call a national emergency and green new deal it

No, they would need to pass a veto proof joint resolution to override the declaration.

That won't happen so the constitutionality of the declaration will need to be contested.

The question I have is, while the case works its way up to the Supreme Court, will the declaration be permitted to take effect?
