Scalia, Thomas, Roberts and Alito can't die for 4-8 years. That's pretty much what this comes down to. It's not like anyone is going to be more liberal than Ginsberg and Stevens, who are the two most likely to retire. I guess Kennedy could retire, and that might be bad.

I would guess Obama would go with a safe choice for his first Scotus appointment--somebody who gets approved 98-2.

Why? Who cares, those people have won the past two.

A lot of my Republican friends are all saying they are praying hard for our country and all this crap. I hope democrats continue to destroy. It is such a horrible attitude that our country is going to cease to exsist because Obama won.

It'll be interesting if/when the time comes, but Obama will find someone more leftist than those two IMHO. I don't know who, but he'll find 'em.

I'm not sure you're going to count to five any easier no matter what there, man.

Is it just me or could the Roggio-Gerlach race possibly get interesting? It's close early according to some results.

Actually, most people think that Souter might be the next to go. Stevens by all accounts plans to die on the bench. But Souter is said to be tired of living in Washington. I suspect he will retire within the next two years. Ginsburg will retire in three. Stevens - who knows.

He's up early in Berks, nothing in for Chester, Montgomery, or Lehigh. I won't expect too much, but just maybe we get a ridiculous upset. I personally picked Gerlach for this at 56-44 overall.

Despite Obama's win, the presidency has been pretty solidly Republican over the past 60+ years, and these justices know it. I wouldn't be surprised if most of the left leaning justices retire while Obama is president just to hedge their bets. If someone bails in the next two years, Obama can literally put whoever he wants on the bench and it's unlikely to get any real threat of opposition.

Iowa for Obama and that all but seals this up. Obama just needs Washington, Oregon, Hawaii and California. Good luck with that McCain.

Well, Karl Rove and I had him at 338, and I was being generous to McCain. I think 320 is the floor at this point.

I had 338, as well.

I started drinking, now I remember I've got a radio interview in an hour. But I'll be fine. I have to come up with something to say about Arkansas, and I've got no results.

I agree which is why I think the only to last past an Obama first term will be Breyer. The others will take this opportunity to get and not risk dying while a Republican is President. With Alito and Roberts, they know that the Democrats need young people in their seats. I would love to see another O'Connor, a true moderate vote splitter, but the current make-up of the Court does not allow Obama to do that.

Despite Obama's win, the presidency has been pretty solidly Republican over the past 60+ years, and these justices know it. It's really early, but right now, the Green Party candidates in Arkansas are getting about 25% of the vote. If that even comes close to holding up, it will be something to talk about for awhile.
