As long as the RNC purchased it legally it should be fine to use. At least that is my understanding of copyright law.

Watching Sarah Palin regurgitate her convention speech verbatim to the lapping swell of mindless cattle in wherever, USA is making me sick to my stomach all over again. This is not a someone with ideas to improve America. This is the joke that's going to start the whole world crying. A perfectly average in every way person is being paraded across America under phony pretenses that she's a qualified leader. It wouldn't surprise me in the least to see the Republicans use her as a tool to get elected then pull the rug out from under her once in office through some sort of internally devised scandal. That's actually the logical next step in this scripted nightmare. This election now has all the makings of a classical farce. I'm dumbfounded.

Watching a Republican rally right now. I admire John McCain's experience as a P.O.W. but I've got to think America is going to get sick of hearing the same biographical speech, almost verbatim, from Palin at each stop along the way. Listening on CNN and haven't heard a single issue discussed in detail yet in 20 minutes I've heard so far. Previously, they were airing an Obama rally where he detailed parts of both his economic and health care plans.

I don't know if Bruce Springsteen objected to the use of his song so much as point out that Reagan was mistaken when he said that Springsteen's Born in the USA was an example of a renewed American optimism.

You mean just purchased it on CD or mp3? The rules for home use are way different than for gatherings. Bars aren't technically allowed to play CDs and things; even lots of jukeboxes are illegal.

I worked at a camp and they were pretty strict on the rules. They said all that was neccesary was that it was purchased legally. Maybe because it isa non-profit (the camp) it is different.

Even camps are legally required to obtain permission for a public performance of music or video, although pursuing this sort of thing is not really effcient for the companies from a economic or public relations standpoint.

Here's a quote form the ASCAP site deining public performance;

Public Performance or Performance Rights
A public performance is one that occurs "in a place open to the public or at any place where a substantial number of persons outside of a normal circle of a family and its social acquaintances is gathered." A public performance also occurs when the performance is transmitted by means of any device or process (for example, via broadcast, telephone wire, or other means) to the public. In order to perform a copyrighted work publicly, the user must obtain performance rights from the copyright owner or his representative.



Now, I assume that the RNC did arrange for rights before they played songs before 30 million people. If Heart has a problem it's probably with their record company.

I don't know about party conventions, but establishments like restaurants are supposed to by licenses from ASCAP and BMI to play copyrighted music. You don't go on a song by song basis, it's a blanket license from the publisher, and they are supposed to distribute the money according to some formula to the composers. The recording companies only get whatever the CD purchase price is. If I'm not mistaken, this also covers the establishment if they bring in a cover band that plays copyrighted music live.

The cost of the license is based on the size of the establishment.
