i feel pretty good about saying he should be charged with manslaughter. pretty much agree with SK here, too. several cars go by without accelerating. probably wanted to cover him in mud or something and misjudged how close he was.

i largelly agree with sk. it was a caution. you can't get him on murder, but i dont see how manslaughter is out of the question.

he has far more control with his car than people seem to be giving him credit for

i believe there is less than a .01% chance he gets charges pressed against him just for the fact that the guy went running into the middle of a race track during a race.

Have there been more videos since that first one that came out late Saturday night? I don't know how you can draw any conclusions either way from something so grainy and dark from a crappy angle, far away.

This. Stewart will be able to bring high-end criminal defense attorneys to shred the very obvious holes in this case. They might charge him, but he's not going to be convicted of anything.

And that's coming from someone who falls into the "he revved the engine to buzz the guy" camp.

What I do know is that the civil suit is going to be fascinating.

Yeah, without a better video, I don't really see any way for a viable criminal case. The civil case will be fascinating with the assumption of risk factors and the self-endangerment, but also the prior hothead actions. I have to think there will be some sort of settlement before it gets too far though.

The only conclusion that can be drawn is that Ward was taking his life in his hands going that far out on to the track.

They'll probably survive the preliminary dispositive motions, go through discovery and get ready for summary judgment, but reach a confidential settlement prior to trial. Defense counsel's goal would be to get it far enough past the incident date so that it's a story buried at like the 43-minute mark of Sportscenter and on page C8 of your local newspaper.
