Not a lawyer, so I'll start with wiki's definition of the 4th amendment:

The Fourth Amendment (Amendment IV) to the United States Constitution is the part of the Bill of Rights which guards against unreasonable searches and seizures, along with requiring any warrant to be judicially sanctioned and supported by probable cause. It was adopted as a response to the abuse of the writ of assistance, which is a type of general search warrant, in the American Revolution. Search and seizure (including arrest) should be limited in scope according to specific information supplied to the issuing court, usually by a law enforcement officer, who has sworn by it.

General search warrants, not based on probable cause, are not permitted under the 4th amendment. A database of DNA to be used to solve crimes would be a type of "general" search warrant, where all records would be searched, even if the record was not a suspect in that case.

I generally dislike slippery slope arguments, but I don't see a big difference between gathering a database of suspects for other crimes (even those that were exonerated), and just building one up on everyone from birth. And the latter is something I don't want my government doing. Either way, it's going to contain searchable information on innocent people, with a non-nil possibility of abuse.

Basically, I don't want the government (or any organization) having my DNA without my permission.

Is AFIS (Automated Fingerprint Identification System) unconstitutional? If so, then there's hundreds (if not thousands) of convicted killers and rapists that should be set free.

IIRC, the initial outcry years ago was "zOMG! It'll be available to insurance companies and employers for DNA profiling!!!"

A law enforcement DNA database would likely be a closed system with safeguards for such abuse. Our legislatures should step up to the plate to insure abuses like the above won't occur.

Cannot believe he doesn't go with an appointee until 2014 if his lawyers thought he could do it

On the other hand, it sounds like if they were going to have a primary, we couldn't have the special general on the same day as the November general because of how the statute is written

Though one basic principle governors appointing people--you make more enemies than friends when you appoint someone. Since there's no clear or obvious choice, Christie might have pissed off the leading contenders he didn't appoint.

He's doing this 'I need to let the people choose who represent them' thing. It sounds nice, but I'd really prefer a Republican representing me for an extra year.

I didn't think Pallone had that much money, definitely changes things. I still have to imagine Booker can close that gap with the national stage he's been out on over the past year and a half.

I have to wonder if Obama or one of his surrogates would get involved as well. We'll see. Definitely going to be interesting.

On that CRNC survey from the other day 3% of college students said taxes should be lowered on the rich. That's pretty hilarious. It's basically the core principle of the Republican party. (I know conservatives will say it isn't but whatever.)
