Well, there is a Law & Order episode where two people are tried for shooting one guy with one bullet. The state knows both were there, but doesn't know which guy is the trigger man, and through some legal mumbo jumbo, though they were originally supposed to be tried together, the trials get severed and neither defendant can admit in court that there is another defendant on trial for the same crime in a different trial without also admitting knowledge that would make it clear who did it.
It always seemed like a load of bull-$#@! to me.
