Judge can't testify because, while Kavanaugh can try to say he never, ever blacked out from binge drinking (and for anyone who has ever done a lot of binge drinking - BS and we all know it) and maybe stay within plausible deniability, no one will buy that from Judge and he would be wise not to swear to it under oath. And also it is highly unlikely he also kept a calendar. All of which means his testimony can be converted from flat denial or "I don't recall" to "I cannot really say either way." He'd couch as "to the best of my recollection" or "not that I recall" but it would be tinged with the reality that his recollection is, thanks to his disease, likely incomplete, and thus he is not valuable as a rebuttal witness.

Got a text message that said somebody trotted out the calendar has definitive proof the Kavanaugh was not at a party on the weekend and question. Really? What a heap of garbage. Unfortunately a little bit I know about law and the way the calendar was framed you could see you what the significance was by making it a legal record as well as the strategy.
