As much as we bitch about mcconnell, Obama saying 'eh fuck off' and just appointing and swearing in a justice without the senate's confirmation would be a disaster (again, it wouldn't be a recess appointment because mcconnell made sure there were no recesses). the judge would be immediately impeached.

he did the same thing in 2017 to make sure Trump wouldn't recess appoint any judges either. pro forma sessions are a completely normal tactic.

Honestly in the interest of fair play and no shit shows I think it would be a better system to simply enter all members in good standing of a bar association in the United States, select one by random lottery, do a standard FBI background check, and once passed they are a federal judge. Supreme Court is a lottery from thus appointed federal judges.

As progressives we often talk about being kinder and more empathetic towards others. Kennedy will be 82 when he retires and has served 30 years on the court. The guy is a human and allowed to retire at an age when most people have been retired for 10-15 years or more and many others are dead. He’s allowed and entitled to stop working and enjoy whatever time he’s got left on this Earth without being pilloried for it.

Kennedy accepted a lifetime appointment for a job where it's common to work well past normal retirement. Given that he's been OK with that for 15+ years, what's another 4 months?

His larger duty is to serve the interests of the nation and help SCOTUS serve its role as a check on POTUS and congress.

Given that our current POTUS is being investigated for colluding with Russians to tilt an election and the GOP congress does nothing to constrain him, Kennedy had a civic duty to postpone his retirement until the midterms.

from a selfish standpoint, all this lower court shuffling this could completely fuck up my wife's work (not too mention all the people she represents) and mean we may have to uproot ourselves for something new at some point.

Or maybe he’s just a Conservative acting in what he believes to be in his and the nation’s best interests by retiring when he can be assured another Conservative will be appointed. Maybe he believes he is in fact serving his larger duty by doing so.

I hate the situation and politics as much as anyone but Kennedy has no duty, civic or otherwise, to act against what he believes to be in his own and the country’s interests.

Which may be (wait for it. . .) what Kennedy believes to be in the nation's best interest. You and I may not, but he may sincerely believe that.

I voted for Trump, I'm glad I did, and it was for this moment. I don't care what else happens if he is able to replace Scalia and Kennedy with two, young, solid conservatives. Bonus if he replaces Thomas next summer.

Of course Kennedy was going to retire. You could see it in his rulings this year. He is a Republican, generally conservative, his family are Republicans, and was appointed by a Republican president. He'll never have a better chance to be replaced by a similar, not opposite, replacement. And he is 81.

I hope blowing up the 60 vote rule for judges by Reid et al to pack the DC Circuit was worth it. It was for me.
