For now, the government is invoking the public safety exception, a designation that allows investigators to question Tsarnaev without reading him his Miranda rights, a Justice Department official told CNN on condition of anonymity.

In ordinary cases, a suspect is told by police he has the right to remain silent and he has the right to a lawyer.

But this is not an ordinary case, say U.S. Sens. John McCain and Lindsey Graham.

They urged that Tsarnaev be held as an "enemy combatant," a designation that allows a suspect to be questioned without a lawyer and without being informed of his Miranda rights.

Watertown police chief sez they believe black cap died when white cap backed over him with the SUV (iow, died from crush trauma).

Whether or not the case, I assume it didn't help.

i thought they said he died during a shootout. in any case, im beginning to wonder about a lot of things surrounding this whole thing, might be a step away from "conspiracy theory", but it leaves me curious

so when and how did black hat blow himself up? unfortunately i am not akin to the studies of a medical examiner, but i would not think the wound on the side of the abdomen to be inflicted from an automobile.

i would think everything would kind of go crunchy inside first, but once again i am not a coroner.

i would think everything would kind of go crunchy inside first, but once again i am not a coroner.

But there's also a whole lot of fluid in there...too much pressure that isht has gotta go somewhere.

Gradually stand on an orange...skin will probably mimic what you see in the pic at some point.

the open chest wound on his side was from the surgeons trying to drain fluid from his lungs

Maybe he didn't asplode himself and there wasn't even a bomb vest. Bad/inaccurate reporting?

Umm, lemme take a look at that pic... Bloody face and shoulder, what looks like a bullet wound in his left side and one or two in his left arm. Not crispy though.

Some pretty good stories pouring out now painting more of a picture of the events as well as fleshing in some background

How String of Events Involving Tsarnaev Brothers Unfolded - Best timeline I've seen of the craziness of Thursday night

NYT with a nice overview on the look into movtives - Inquiry Shifts to Suspect’s Russian Trip and the interesting nugget that the older brother's citizenship request for citizenship because of the prior FBI interest (though as the first story makes clear, they did not follow up post Russia visit).

Late last year, Homeland Security officials contacted the F.B.I. to learn more about its interview with Tamerlan Tsarnaev, federal law enforcement officials said. The F.B.I. reported its conclusion that he did not present a threat.

That doesn't really mean much, in reality. They targeted him as a POI and cleared him after an interview. We don't know what the FBI had on him or what happened during the interview.
