On Tuesday, voters in Eureka Springs will head to the polls to decide if the city should repeal an anti-discrimination ordinance the City Council passed in February.
In February the state legislature passed a bill that bans cities from passing non-discrimination ordinances. So the Eureka Springs City Council passed ordinance 2223 before Governor Asa Hutchinson could sign the state bill into law.
Critics say the Eureka Springs community is already among the most tolerant communities in the state and did not need to pass legislation to make it a safe place for minorities.
Like many in Eureka Springs, McGhee was surprised when the City Council passed ordinance 2223.
"I'm really surprised that it went through, that it was voted on as quickly as it was. I'm gay but I voted against it," said McGhee.
"What's the need for it, if there's a community in Arkansas that's open and welcoming it's Eureka Springs," said former Eureka Springs Chamber of Commerce president Mike Bishop, who says, now that the ordinance is on the ballot, he’s going to vote against it.
Bishop says the town didn't need an anti-discrimination ordinance on the books.
"None of us are for discrimination of any kind, we're not for that. We are for protecting religious freedoms; we're for protecting the business community and the perception of our community," said Bishop.
"I think down on the street level we're a very tolerant town and we really do appreciate and love each other," said business owner Steve Arnold.
Arnold owns a business in Eureka Springs; he's in favor of keeping the ordinance but says he understands why some are upset.
"I think a lot of them really do feel like they're rights are being infringed upon by protecting other people's rights and there's a tug of war with that," said Arnold.
