I'm no lawyer, but I'll offer my opinion anyway. Reselling stuff is totally legal--I mean, you can do it with copyrighted materials as long as it's the physical object--DVD, CD, Book, whatever. And of course hair salons like to tell you that you should only buy hair care products from them, not CVS, but I suspect that's a crock. So it would stand to reason that you could sell Cheerios, Trader Joe's Condoms, or whatever to anyone you wanted. What's at issue is whether calling his store Pirate Joe's is an infringement of Trader Joe's trademark. If I understand trademark legal practices, I think if you want to keep your trademark, you have to actively defend it against potential infringers. I think that's why MLB for instance went after youth teams that adopted MLB team names/logos.

Also, of course, big companies use lawsuits that may not have much merit to discourage behavior they don't like. SLAP lawsuits are an example, and I doubt non-compete clauses are likely to hold up in court. So, Trader Joes may lose in court, but they'll still achieve the desired effect if they successfully discourage any imitators.

On a plane to SF and the woman sitting one row up and across the aisle is one of the most attractive women I've ever seen, which is nice.
