NEWS: The FBI has just released a statement about the NASCAR noose incident at Talladega, indicating it was a misunderstanding. No crime was committed. The noose was already there as early as last year.

per the replies, it sounds like the “noose” is actually just rope tied in such a way that is typically used to close garage doors at tracks, which begs the question "how was this not immediately known"

Someone alluded to this earlier, pretty much every teacher, nurse, etc that I know has been assaulted at work before, if they just slapped on a sleeper hold in response they’d be fired immediately.

When you're right You're right Bucky. It's the same different problem with the words global warming. it describes something, but not well enough that it can't be misunderstood and/or manipulated. The goal is something that seems palatable to most everybody in law enforcement, but the word defund and their paycheck is pretty much a nonstarter

Ha ha! Great catch! One of the good things about being the winner of the conflict is we can change definitions to suit our needs. Somebody from the South might argue - not without merit - that what the Civil War established, legally, was that the "Confederate States of America" never existed as a legal entity because it was illegal for the states to secede, and so all military service to the several Southern states was in fact service in the armed forces of the United States.

Of course that last part is an absurdity because even disregarding the Confederacy as a legal entity, those Confederate armies were at best state militias, not armed forces of the federal entity, and they were in open rebellion against the federal entity.

The War enforced Lincoln's legal theory that membership in the Union was permanent and a state could not secede. The Emancipation Proclamation was issued on the notion that there was no Confederacy and Lincoln was still president of the rebelling states. On the other hand, when it came to the Fugitive Slave Act, after early moments where some Union generals obeyed the act and returned escaped slaves to the South (since the South in the Union theory was still part of the USA and therefore federal law was still controlling), General Benjamin Butler, early in the War, established what became the Union position on the matter, as in this exchange with Major John Baytop Cary of the Confederacy, recounted by Adam Goodheart:

Cary got down to business. “I am informed,” he said, “that three Negroes belonging to Colonel Mallory have escaped within your lines. I am Colonel Mallory’s agent and have charge of his property. What do you mean to do with those Negroes?”

“I intend to hold them,” Butler said.
“Do you mean, then, to set aside your constitutional obligation to return them?”

Even the dour Butler must have found it hard to suppress a smile. This was, of course, a question he had expected. And he had prepared what he thought was a fairly clever answer.

“I mean to take Virginia at her word,” he said. “I am under no constitutional obligations to a foreign country, which Virginia now claims to be.”

“But you say we cannot secede,” Cary retorted, “and so you cannot consistently detain the Negroes.”

“But you say you have seceded,” Butler said, “so you cannot consistently claim them. I shall hold these Negroes as contraband of war, since they are engaged in the construction of your battery and are claimed as your property.”

I read about the Elijah McClain case couple days ago, one of the most harrowing things I've read. Happened in 2019 and I had never even heard of it
