Nothing really.
Everyone is entitled to their opinion. If he thought Trump obstructed justice he should have the balls to come out and say so rather than walking the fence and telling both sides "I don't agree with that characterization."
Furthermore, the chances the DOJ would actually pursue charges after a President left office are slim to none.

Is it about having the balls to do it or about that not being the process to do it? It’s well trodden ground to say that Mueller as special prosecutor couldn’t indict a sitting president and would have needed Congress to do its job with impeachment/prosecution.
