So what is the point of these subpoenas the dems are issuing if there are no repercussions for ignoring them? I mean I guess they can go to court and have people thrown in jail....but doesn’t burr’s justice dept have to enforce it? And what if trump says no to a subpoena AND no to a court decision?

Contempt of Congress is a federal misdemeanor, punishable by a maximum $100,000 fine and a maximum one-year sentence in federal prison. Will it be enforced is a different question. I am not sure that this involves the Justice Department.

Well, we do have a lawless administration, but so far they have not defied either of the other branches of government. The reality is the judiciary is rapidly losing credibility--not really because of Trump, but due to a series of partisan 5-4 decisions that really go back to at least Bush v. Gore in 2000. The court is going to become a political football. I do think one reason to oppose Biden and others of his ilk is that he still wants to believe that bi-partisan cooperation and respect for the norms and conventions of American politics are still a thing. He seems to be making the mistake that once we get rid of Trump, all will be well. But really, the Republicans are playing a different game, and have been for some time. There's some interesting literature on how this really gets going with Newt Gingrich, but McConnell is not someone you can negotiate with. As long as McConnell or someone like him is in the leadership, the Republicans are simply not playing this game in good faith. So, if we do manage to get Democratic majorities, they are going to have to pack the court, eliminate the filibuster, and do exactly the kinds of things that Democrats like Biden (and to be honest, I'd put Hillary in this category) seem unwilling to do. We can't go back to the bi-partisan world of the 80s, not anymore.
