Seems he's arguing the President is not above the law but is answerable under the Constitution to Congress. It's also, at least from these excerpts, a seemingly theoretical exercise asking Congress to pass laws that don't exist.

Will be interesting to see what Kavanaugh says during confirmation about all of this, but if this is the Dem focus on his record there's a 100% chance he's confirmed bc nonsense like this isn't moving Collins or Murkowski. Might be useful at ginning up already excited Dem base voters, I guess.

I would be surprised if he didn't walk some of that back. Maybe not the 'a sitting president can't be indicted' part but that's not a completely unpopular opinion.

Arizona's Republican Primary isn't until August 28th. Jersey (and others who feel like opining) what do you make of the late primary? Favors the Democrat because less time for the Republican to coalesce support? Favors the Republican because the support will coalesce and the Democrat could be caught unaware when polls stop going from hypothetical with three remaining GOP choices to just one? Neither? Both?

These people care about their legacy, I'll leave it to sharper legal minds, but off the cuff it makes me think that he cared more about his first amendment jurisprudence (Citizens United, the recent abortion speech case) than his social legacy. It could also trigger to his personal belief that Kavanaugh does believe in stare decisis and most of his legacy will remain intact. Who knows, but I'm not giving him the benefit of the doubt.

I especially come back to his concurrence in the travel ban case. It was scathing, or as scathing as a Supreme Court opinion can get, but it still ruled in favor of upholding the travel ban. If it was a concurrence to Sotomoyer's hot fire opinion, then I'd be more confident in his legacy and more optimistic about the Court's future (also he would probably have stay on the bench to wrap up gerrymandering and other issues).

seems like it's an indication of how he might rule if the question comes before him, which it just might in the months ahead. I also don't represent all dems, so I doubt it will be the Dem focus. It was just the focus of my post. It's also exactly the type of thing that Trump would look at ... how can this guy help me. And finally, this guy seems like yet another authoritarian asshole dressed up in traditional conservative garb. Oh, and it's not nonsense when you have a runaway executive.
