It lapsed and the original ban made it illegal to manufacture and sell IIRC. It was not illegal to possess, and the only way to truly try and get them back would be large scale buy-back programs.
I agree that I think this is the way it would have to work. It would be illegal to sell to non-governmental body. I presume they would still be manufactured for military and law enforcement. Not illegal to possess but you have to fund up buy back programs.
