Simple does not meet the sniff test for murder. Premeditation is the bar. This idiot did not premeditate anything about killing the woman. So it has to take a different path. Maybe CA is different, but my exposure to not being able to avoid jury duty we had all the criminal options on the table starting at the highest charge brought. It was painful. I am not sure if that is a VA requirement, of if all those charges were brought as a pick'em.

The prosecutor in this case chose to go with murder 1 and that he aimed the gun at her and fired. Except...the bullet ricocheted (off the ground?).
