As an attorney, I could not disagree with you more on the mandatory retirement age thing. Even here in Virginia, where judges are appointed rather than elected, and are ostensibly evaluated prior to reappointment, you end up with older judges who are simply not capable of doing their job anymore, and it's damn near impossible to prevent a person from getting reappointed absent true malfeasance (or a political sin, like when a Circuit Court judge in the late 90s wasn't reappointed because she was rumored to be a lesbian). Judges don't lose their jobs for regularly checking out of hearings, getting significantly behind on their letter opinions, or issuing a few bad rulings that impact people's lives, but these are things that typically increase in frequency as a judge passes retirement age.

In 2015, we bumped up the mandatory retirement age from 70 to 73 (partly because there is already an insufficient number of judges out there), and that seems more than sufficient IMO. Yes, we lose some good judges when they get forced from the bench, but that is far and away the exception rather than the rule. And those good judges can be kept on as substitute judges or state-sponsored mediators, so they remain a valuable resource to attorneys and litigants.

These aren't appellate judges where they have regular terms but outside of those period can schedule their days as they see fit... these are general district and circuit court level judges who often have grueling daily dockets combined with a significant amount of administrative work. In the more rural areas, a judge may be in five different counties each week. That's not a job for a person approaching 80.
