This is a #$!&@ up story. The guy was convicted 9 years ago for aiming a gun into a car full of people he had gotten into an argument with, he received a 10 year suspended sentence for that.
In this case, the prosecution asked for $100,000 bail and the Judge released him with no bail. Seems like the judge has the communities saftey in his best interest.
A suspended sentence is the judicial delay of a defendant's duty to start serving a sentence once he or she has been convicted or found guilty, so that the defendant is able to perform an intervening probation period.

In this climate I am loath to admit it, but I do have mixed feelings about this.
A crime is being committed here that arguably depresses wages both for the people in question and for the community at large, and deprives citizens and/or documented guests of work.
I think something should have been done.
That something is: come in and serve the goddamn employer with one hell of a fine that can be greatly reduced or eliminated by doing the following:
1. Submit expedited guest worker application visas for the people in his/her employ;
2. Certify and/or prove that you are doing all of the following: paying these people the federal minimum wage; backpaying them for any hours paid that were not at the minimum; paying and backpaying for all such employees all Medicare, social security, and other applicable taxes;
Or the employer can pay the prohibitive fine, which will be used to compensate employees who will no longer be able to work and will have to either return home or apply for residency status, for which they will be given priority status (meaning they will be fast-tracked). The employer may then hire properly documented workers, of course. If the employer decides to declare bankruptcy in order to try to avoid either, the government becomes the first-in-line creditor who must be made completely whole before anyone else gets a dime. Assets liquidated in such a proceeding will again be used to compensate dismissed employees, documented or otherwise.
Or they could just hire correctly in the first place!
The point is: it is a problem, it does cause resentment, it has an economic impact, and the cause of almost all of it is: capitalists. So the punishment should be theirs.
