Should be easy. Democrats filibuster any Kennedy replacement. With Republicans down to 51 members and McCain ailing, it would take all 50 Republicans to go nuclear, and Collins and Murkowski will be very hesitant to cross that line for a doctrinaire Federalist Society type nominee replacing a moderate.
It is a very good thing they didn't decide to filibuster Gorsuch and allow Republicans to pull the nuclear trigger then when they were in a position of strength.
