Accidentally? How about when teachers start shooting their students on purpose and then claiming they were attacked and were defending themselves?

The lawyer is a piece of shit, but the state should be on the hook for any and all mental health bills that the child accumulates. Every survivor should get that. can't imagine how fucked up experiencing this could make a 6 year old.

Why? How is the state in any way liable here based on the limited info we have available to us?

Here is the argument:

He said the State Board of Education, Connecticut Department of Education, and State Commissioner of Education failed to protect his client from “foreseeable harm” by not providing a safe setting, failing to determine whether the local Newtown Board of Education had provided a safe setting, and failing to require the school and the local board to make an emergency response plan.

what a joke. it took 15 shots just to get into the place. this lawyer is scum. the parents are beyond distraught and some unscrupulous lawyer has warped them.

In most places, school districts are not part of the county or the city.

Anyway, I was on a jury once and the case was where a bank customer sued the bank because he was shot during a robbery, claiming the bank had not provided adequate security. After two weeks of testimony, our verdict would probably have hinged on the judge's definition of liability. We never got to that point though, because the parties settled before the judge delivered his instructions to the jury. I think the main purpose of the trial was to determine the degree of liability between the bank and the security company that provided the security guard to the bank. It was pretty clear that the security company was pretty much off the hook after two weeks of testimony.

In short, such a lawsuit isn't all that uncommon.
