I'm a liberal, so this is sacrilege, but, in a limited way, I actually agree with part of Scalia's point. I think Scalia is wrong on the law, I think the decision is absolutely correct, but it's kind of obvious that the majority was overtly trying to write an opinion that would be quoted by poets and philosophers 300 years from now, more than trying to write an opinion ruling on the law. To me, this was a perfect example of a case to bring before the Supreme Court (some states issue contracts that others will not honor: screams SCOTUS intervention to determine whether said contracts are valid), but the structure of the opinion really should have been about the current situation of some states issuing these contracts and others not honoring them, the question of whether or not defining marriage - as a legal matter - to be something only a man and woman can enter into, and not 2 men or 2 women violates equal protection/equal access to protection of the law, and ruling in favor of the plaintiff on that basis. The highfalutin notion that the justices are ruling on whether two people of the same sex should be able to love one another or make a union or etc. is sort of outside the scope of the law, and more about making a spectacle of beautifully they can write about such subjective issues rather than how precisely they can apply the law in this case.
